These Terms & Conditions apply when you use the EleFitnessDance website, book or attend an in-person class, purchase digital content, or access the Online Wellness Library.
By making a booking or purchase, you agree to these terms.
1. About EleFitnessDance
EleFitnessDance provides in-person fitness classes, online workouts, recipes and general fitness and wellbeing content.
The information and content provided are for general educational and wellbeing purposes only. They are not a substitute for personalised medical advice, diagnosis or treatment.
2. Health and fitness disclaimer
You are responsible for deciding whether a class, workout or other activity is suitable for you.
Before participating, please seek advice from an appropriate healthcare professional where necessary, particularly if you:
have an injury or medical condition;
are pregnant or have recently given birth;
are recovering from surgery;
experience pain, dizziness, chest discomfort or unusual shortness of breath; or
are unsure whether exercise is suitable for you.
You should exercise within your own ability, follow safety instructions and stop immediately if you feel unwell or experience pain.
Participation in fitness activities carries an inherent risk of injury. Nothing in these terms excludes or restricts any liability that cannot legally be excluded, including liability for death or personal injury caused by negligence.
3. In-person classes and bookings
Where advance booking is required, places must be booked through the booking system or another method approved by EleFitnessDance.
Class prices, times and locations will be displayed at the time of booking.
Class timetables, instructors and locations may occasionally change because of illness, venue availability, weather, safety concerns or other circumstances outside our reasonable control.
Where EleFitnessDance cancels a paid class, you will normally be offered a transfer, credit or refund, as appropriate.
Loyalty cards, discounts and promotional offers are subject to their stated conditions and may be changed or withdrawn for future purchases.
4. Customer cancellations for in-person classes
Refunds or transfers for customer cancellations are not guaranteed unless a separate cancellation policy is displayed when booking.
Please contact EleFitnessDance as early as possible if you cannot attend. Any transfer or credit offered is discretionary unless otherwise stated at the time of booking.
This section does not affect your statutory rights.
5. Online Wellness Library
The Online Wellness Library is a digital product containing fitness videos, mobility and stretching sessions, recipes, breathing and relaxation resources, and general wellbeing guidance.
The exact content included is described on the sales page at the time of purchase.
Access is for your personal, non-commercial use only.
You must not:
share your login details with another person;
record, copy, reproduce or redistribute the content;
upload the content to another website or platform;
sell, license or otherwise make the content available to others; or
use the content to provide classes, coaching or other commercial services.
EleFitnessDance may suspend or terminate access where there is evidence of account sharing, unauthorised copying, misuse or another serious breach of these terms.
6. Price and payment
The Online Wellness Library is sold for the one-off price displayed at checkout.
It is not a monthly subscription and there are no recurring membership charges unless a different product is clearly described as recurring before purchase.
Payment must be completed before access is provided.
7. Immediate digital access and cancellation rights
Access to the Online Wellness Library is supplied immediately after purchase.
Before immediate access begins, you will be asked to:
expressly agree that the digital content may be supplied immediately; and
acknowledge that once supply begins, you will lose your statutory 14-day right to cancel.
UK rules require both express consent and acknowledgement before digital content is supplied during the normal cancellation period. If this process is not followed, the customer may retain the right to cancel.
Once you have requested immediate access and access has begun, the purchase is normally non-refundable.
This does not affect your statutory rights where the digital content is faulty, unavailable or not as described. Digital content must match its description, and consumers may have rights to repair, replacement or an appropriate price reduction where it does not conform to the contract.
8. Access duration
Your one-off payment provides ongoing access to the Online Wellness Library for as long as the library remains available.
The purchase does not include a guarantee of lifetime access.
EleFitnessDance may eventually discontinue the Online Wellness Library, the website or the fitness business. Where reasonably possible, customers will be given advance notice before paid access is permanently withdrawn.
Nothing in this section removes any statutory remedy that may apply if digital content is withdrawn or ceases to conform to the description under which it was sold.
9. Changes to the library
EleFitnessDance may occasionally add, remove, replace or reorganise individual videos, recipes or other resources.
Regular additions or monthly updates are not guaranteed unless expressly stated at the time of purchase.
Any changes will not intentionally remove the essential nature or overall value of the product originally purchased.
10. Technical requirements and availability
You are responsible for having a suitable device, internet connection, browser and any other technology needed to access the Online Wellness Library.
Temporary interruptions may occur because of maintenance, internet problems, hosting-platform outages or circumstances outside EleFitnessDance’s reasonable control.
EleFitnessDance will take reasonable steps to restore access where a problem is within its control but cannot guarantee that the website or every item of content will be available without interruption at all times.
11. Intellectual property
All videos, photographs, written materials, recipes, downloads, designs, logos and branding provided by EleFitnessDance remain the intellectual property of EleFitnessDance or the relevant rights holder.
Purchasing access gives you a limited right to view and use the content personally. It does not transfer ownership or intellectual-property rights to you.
12. Limitation of liability
EleFitnessDance does not exclude or restrict liability where doing so would be unlawful.
Subject to that, EleFitnessDance is not responsible for loss or harm caused by:
failing to follow the safety guidance provided;
exercising beyond your own ability;
using unsuitable equipment or an unsafe exercise space;
an undisclosed medical condition;
misuse of the website or content; or
internet, device or third-party platform problems outside our reasonable control.
Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.
13. Privacy
Personal information is handled in accordance with the EleFitnessDance Privacy Policy.
Payment information may also be processed by Squarespace and the connected payment provider under their own privacy terms.
14. Changes to these terms
These Terms & Conditions may be updated from time to time to reflect changes in the services, website or applicable requirements.
The version applying to a purchase is normally the version displayed when that purchase is made. Any later change will not remove rights already acquired under an earlier purchase.
15. Governing law
These terms are governed by the laws of Scotland.
Nothing in this section affects any mandatory consumer rights regarding where you may bring a claim.
